These Terms & Conditions govern all purchases and interactions between Beauty Is A Right ® ABN 95 767 395 802 (“we”, “us”, “our”) and our customers. By purchasing our products and using our website you agree to these Terms & Conditions.

Individual Results and Sensitivities

Individual sensitivities, allergies and responses to ingredients may vary, and customers are responsible for reviewing product ingredients prior to purchase and use.

Our products are cosmetic products only. Individual results may vary depending on skin type, health factors, usage and other circumstances beyond our control. Beauty Is A Right® does not guarantee any particular result from the use of its products.

We recommend patch testing before full use, as a precaution, especially if you have sensitive skin, allergies, a medical condition, or concerns regarding suitability, we recommend seeking professional medical advice before use. Customers should discontinue use immediately and seek appropriate medical advice if irritation, discomfort or any unexpected reaction occurs.

Product Use and Misuse

Beauty Is A Right® products must be used strictly in accordance with any instructions, directions, warnings and recommendations provided on the product packaging, website or accompanying materials.

Customers are responsible for ensuring that products are used appropriately and only for their intended purpose. Beauty Is A Right® accepts no liability, to the fullest extent permitted by law, for any loss, damage, injury, adverse reaction or dissatisfaction arising from:

  • misuse, abuse or improper storage of a product;

  • use of a product contrary to any instructions, warnings or recommendations;

  • use of a product after its expiry date or recommended period after opening;

  • use of a product in combination with other products, ingredients or treatments not recommended by Beauty Is A Right®;

  • use of a product on damaged, broken, infected or irritated skin contrary to product directions; or

  • failure to undertake recommended patch testing prior to use.

Intellectual Property All intellectual property rights in our products, branding, trademarks, logos, content, images and website materials remain the property of Beauty Is A Right®.

Limitation of Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law ("ACL") or any other applicable law that cannot be excluded, restricted or modified by agreement. To the fullest extent permitted by law:

  • Beauty Is A Right® excludes all warranties, representations and guarantees not expressly set out in these Terms & Conditions;

  • Beauty Is A Right® shall not be liable for any indirect, incidental, special, consequential or economic loss or damage, including loss of profit, loss of revenue, loss of business opportunity, loss of anticipated savings, loss of goodwill or reputational damage, arising from or in connection with the purchase or use of our products, whether arising in contract, tort (including negligence), equity, statute or otherwise;

  • Beauty Is A Right® shall not be liable for any adverse reaction, sensitivity or allergy resulting from the use of its products where ingredients have been correctly disclosed and the product has been used contrary to instructions, warnings or recommended patch testing procedures;

  • To the extent permitted by law, our total aggregate liability arising out of or in connection with the supply of goods or these Terms & Conditions shall be limited to the purchase price paid for the relevant product giving rise to the claim or replacement of the goods.

Nothing in these Terms & Conditions limits or excludes liability for a failure to comply with a consumer guarantee under the ACL where such liability cannot lawfully be limited or excluded.

Prices in AUD: All prices are displayed in Australian Dollars (AUD) and include GST, where applicable. Payment must be received in full prior to dispatch.

Our Website While we endeavour to ensure information on our website is accurate and current, we do not warrant that all information will be complete, accurate or free from error.

Order Acceptance and Cancellation: We reserve the right to refuse or cancel an order where there has been a pricing error, stock availability issue, suspected fraud, or other reasonable circumstance.

Changes to Terms & Conditions We may update these Terms & Conditions at any time. The latest version will always be available on our website.

Governing Law: These Terms & Conditions are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
